How does WhatsApp marketing work — and is bulk WhatsApp legal?

WhatsApp marketing works in two very different modes: the official WhatsApp Business Platform (API), where customers opt in and businesses pay per conversation — fully legitimate and extremely effective in India — and grey-market bulk blasting to purchased number lists, which violates WhatsApp's terms, gets numbers banned, and in many cases runs afoul of India's consent-based data rules. The first is a growth channel; the second is a countdown to losing your number.

Why WhatsApp matters more in India than anywhere

For most Indian customers, WhatsApp IS the internet’s front door — orders, support, payments, everything. Response rates on legitimate WhatsApp conversations dwarf email. A business reachable on WhatsApp feels real; one that isn’t feels distant.

The legitimate machine (what actually works)

  1. Inbound first. “Chat on WhatsApp” buttons on your site and ads — the customer initiates, no consent question exists. This alone outperforms contact forms dramatically.
  2. Opt-in broadcasts via the official API. Customers who consent get order updates, offers, restock alerts — through approved templates, with per-conversation pricing. Delivered from a verified business identity.
  3. Automation with a human handoff. Instant answers for catalog/price/timing questions, a human within minutes for buying signals. Speed-to-lead is the single biggest conversion lever most businesses ignore.

The grey market (what gets sold to you)

“5 lakh messages for ₹15,000” panels use unofficial gateways and scraped number lists. What actually happens: delivery rates collapse, your number gets banned (often the founder’s personal number — a business-crippling own goal), and unsolicited marketing to numbers that never consented sits badly with India’s DPDP-era consent rules. Cheap reach that costs you your primary customer channel is not cheap.

The one-line rule

If the recipient didn’t message you first or explicitly opt in, don’t send it. Everything durable in WhatsApp marketing is built on that rule.
